According to this piece in the New York Times, private attorneys fair much better on average for their clients than public defenders. What’s more, private attorneys generally get more difficult cases.
When we examined the seriousness of the cases handled by each type of lawyer, we discovered not only that private lawyers tend to handle more serious cases, but also that as the seriousness of the case increases, the chances that a private lawyer is handling it also increases.
With no disrespect to public defenders whatsoever, this does not surprise me. The compensation of a private attorney is tied much more closely to their success rate than that of a public defender. However, a factor to consider in the favor of public defenders is that private attorneys can be more selective in the cases they take.
